These Terms of Service ("Terms") govern your use of the services provided by janejanvgy B.V. ("we," "us," "our," or "janejanvgy") at our wellness and fitness studio located at Hoofdstraat 194, 9728 LW Groningen, Netherlands. By booking, purchasing, or using any of our services, you agree to be bound by these Terms.
By accessing our website, booking our services, or using our facilities, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not use our services. These Terms constitute a legally binding agreement between you and janejanvgy B.V.
janejanvgy provides holistic wellness and fitness services including but not limited to group fitness classes, personal training sessions, yoga and mindfulness classes, wellness coaching, and related health and fitness services. All services are provided at our studio location or as otherwise specified. Service descriptions, schedules, and pricing are subject to change with reasonable notice.
All bookings must be made in advance through our approved booking methods. Payment is required at the time of booking unless otherwise arranged. We accept various payment methods as specified during booking. Prices are in Euros and include applicable VAT. We reserve the right to modify our pricing with reasonable notice. Package deals and memberships are subject to their specific terms and conditions.
Class cancellations must be made at least 24 hours in advance. Personal training sessions require 48 hours notice for cancellation. Late cancellations or no-shows may result in forfeiture of the session. Refunds are provided in accordance with Dutch consumer protection laws. Package deals and memberships have specific cancellation terms that will be communicated at the time of purchase. Emergency situations will be considered on a case-by-case basis.
You must disclose any health conditions, injuries, or physical limitations that may affect your participation in our services. You acknowledge that physical exercise involves inherent risks and that you participate at your own risk. You must follow all safety instructions provided by our staff. We reserve the right to refuse service or ask you to leave if you pose a safety risk to yourself or others. You are responsible for consulting with healthcare professionals before beginning any fitness programme.
All clients must respect our facility, equipment, and other participants. Appropriate workout attire is required. Mobile phones should be silenced during classes. We maintain a harassment-free environment and reserve the right to remove anyone who violates this policy. Damage to equipment or facilities may result in repair charges. Photography or recording is not permitted without express permission.
All content on our website, including text, graphics, logos, images, and software, is the property of janejanvgy B.V. or our licensors and is protected by Dutch and international copyright laws. Our training methods, class formats, and proprietary wellness programmes are our intellectual property. You may not reproduce, distribute, modify, or create derivative works from our content without written permission. The janejanvgy name and logo are registered trademarks and may not be used without authorisation.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy. We comply with the General Data Protection Regulation (GDPR) and other applicable privacy laws.
To the maximum extent permitted by Dutch law, janejanvgy B.V. shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of our services or facilities. Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you have paid to us in the twelve months preceding the claim. This limitation applies regardless of the theory of liability, whether based on warranty, contract, statute, tort, or otherwise.
You agree to indemnify, defend, and hold harmless janejanvgy B.V., its directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of another person or entity.
We shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government regulations, or public health emergencies. In such cases, we will make reasonable efforts to provide alternative arrangements or appropriate refunds.
We reserve the right to terminate or suspend your access to our services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use our services will cease immediately. Termination does not relieve you of any obligations that accrued prior to termination. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, limitation of liability, and governing law clauses.
We reserve the right to modify these Terms at any time. Changes will be posted on our website and will be effective immediately upon posting. Your continued use of our services after any such changes constitutes your acceptance of the new Terms. We recommend reviewing these Terms periodically to stay informed of any updates.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
We encourage resolving any disputes through direct communication. If you have a complaint or concern, please contact us first to allow us the opportunity to address the issue. If we cannot resolve the matter informally, any legal disputes will be handled through the appropriate Dutch courts or alternative dispute resolution mechanisms as required by Dutch law.
